State’s Attorney Joe Bruscato

Winnebago County State’s Attorney Joe Bruscato announces that David B. Marshall (D.O.B. 1/6/1978) pled guilty to Arson and Residential Arson in front of the Honorable Judge Fernando Engelsma.  Marshall was sentenced to a total of 14 years in the Illinois Department of Corrections and will be on Mandatory Supervised Release for two years once he is released from prison.

On September 27th, 2016, Rockford Firefighters were called to an early morning fire at 1610 Charles Street.  As they were responding to that residence, the fire department received another call for a separate fire nearby at 2001 Charles Street.  The home at 1610 Charles Street was unoccupied, but there were people living inside the multi family residence at 2001 Charles at the time of the fire.  Investigators determined that both fires were set by David Marshall, who was seen in the area around the time of fires.

Arson is a Class 2 Felony that is punishable by a sentence of 3-7 years in the Illinois Department of Correction followed by two years of Mandatory Supervised Release. Marshall was sentenced to 7 years in the Illinois Department of Corrections on this charge.

Residential Arson is a Class 1 Felony that is punishable by a sentence of 4-15 in the Illinois Department of Corrections followed by two years of Mandatory Supervised Release.  Marshall was sentenced to 7 years in the Illinois Department of Corrections on this charge.  The sentences will be served concurrently.
