Press Release-David Seaton Sentence

Winnebago County State’s Attorney Marilyn Hite Ross announces that on February 25th, 2019, David D. Seaton (D.O.B. 12/11/1963) was sentenced to a total of 28 years in the Illinois Department of Corrections by the Honorable Judge John Lowry. The defendant will also be on Mandatory Supervised Release for three years and will be required to register as a sex offender for the rest of his life as part of the sentence. Seaton was found guilty of one count of Predatory Criminal Sexual Assault of a Child and three counts of Aggravated Criminal Sexual Abuse after a jury trial in September of 2017.

In January of 2015, Winnebago County Sheriff’s Detectives conducted an investigation into allegations of sexual abuse by two victims who were under the age of 13.  The abuse occurred between February of 2000 and February of 2005.  At the time of the offenses, Mr. Seaton’s wife owned and operated an at-home daycare called Pam’s Daycare. 

 

Predatory Criminal Sexual Assault of a Child is a Class X Felony that is punishable by a sentence of 6-30 years in the Illinois Department of Corrections followed by three years of Mandatory Supervised Release. The defendant will also be required to register as a sex offender for the rest of his life as part of his sentence. Seaton was sentenced to 16 years in the Department of Corrections for this offense.  The sentence will run consecutive to the other sentences.

Aggravated Criminal Sexual Abuse is a Class 2 Felony that is punishable by a sentence of 3-7 years in the Illinois Department of Corrections followed by two years of Mandatory Supervised Release.  Seaton was convicted of three counts of this offense, and sentenced to four years on each count. All these sentences will run consecutive to the other sentences.
