State’s Attorney Marilyn Hite Ross
Winnebago County State’s Attorney Marilyn Hite Ross announces that a Peoria, Illinois man has been indicted for aggravated battery to a child.
On November 9th, 2018, Officers with the Rockford Police Department responded to a local hospital after a report that a child had been battered. Officers observed multiple visible injuries to a minor under the age of 13. A follow up investigation was reviewed by the Winnebago County State’s Attorney’s Office. As a result, the defendant,Davone Holley (D.O.B. 2/23/1989) was charged, and recently indicted by a Winnebago County Grand Jury for Aggravated Battery to a Child.
Aggravated Battery to a Child is a Class 3 Felony that is punishable by a sentence of 2-5 years in the Illinois Department of Corrections followed by one year of Mandatory Supervised Release.
Holley is scheduled to be arraigned on the indictment at 9:00am on April 1st, 2019, in front of the Honorable Judge Joseph McGraw in Courtroom A at the Winnebago County Criminal Justice Center.
The charges are merely allegations and the defendant is presumed innocent until or unless proven guilty in a court of law.
