Press Release-Sheriff Lawsuit Settlement

Winnebago County State’s Attorney Marilyn Hite Ross announces terms of an agreement to settle a lawsuit filed by Sheriff Gary Caruana against Winnebago County, County Board Chairman Frank Haney and County Treasurer Susan Goral.    

 

On March 29th, 2019, Winnebago County Sheriff Caruana filed a lawsuit asking the court to order the Winnebago County Board to restore funding to the Sheriff’s Department’s 2019 budget. After months of negotiations a settlement was reached in July of this year.  The agreement requires the County Board to approve a budget amendment of $1.7 million for the Sheriff’s Department’s 2019 budget. The money will be used to pay the salaries for 24 Deputies. The settlement requires that Sheriff Caruana pay for the fees of his court-appointed special prosecutor out of his 2019 budget.

As part of the settlement, the Sheriff agreed to dismiss his lawsuit against the County, Haney and Goral. The settlement requires that the appointment of the Sheriff’s special prosecutor will be amended by the court to terminate representation for 2018 and 2019 budget issues.

 

The Winnebago County Board approved a resolution to accept the settlement and the associated budget amendment.  Orders were entered today before the Honorable Judge Lisa Fabiano amending the appointment of a special prosecutor and before the Honorable Judge Stephen Balogh dismissing the Sheriff’s Lawsuit. State’s Attorney Hite Ross stated, “I am pleased that our Winnebago County leaders have been able to work together collectively to resolve the issues.”
