Winnebago County State’s Attorney Joe Bruscato announces that Antwan Maxey (D.O.B. 10/3/1984) was sentenced to 22 years in the Illinois Department of Corrections by the Honorable Judge Donna Honzel. Maxey was found guilty of ten counts of Aggravated Driving Under the Influence of Alcohol Involving Great Bodily Harm after a jury trial in March.
In June of 2015, Rockford Police were called to the area of Auburn and Bluefield Street for a traffic crash. When officers got there, they saw a heavily damaged vehicle. An investigation revealed the vehicle had been eastbound on Auburn when it ran off the south side of the road and struck a retaining wall. The vehicle then came back across the roadway, crossing all 4 lanes of travel, before striking a utility pole and coming to rest. The driver, Antwan Maxey, was hanging out of the driver’s side front window with his right leg stuck under the steering wheel. Maxey was breathing, but unresponsive and bleeding from the head. Maxey’s blood alcohol concentration was .131. Two passengers in the vehicle with the defendant at the time suffered spinal fractures and other injuries as a result of the crash.
Aggravated Driving Under the Influence of Alcohol Involving Great Bodily Harm is a Class 4 Felony punishable by probation or special sentencing of 1-12 years in the Illinois Department of Corrections. Any sentence to the Department of Corrections would be followed by one year of parole. The defendant was sentenced to 12 years for this offense.
The defendant was previously convicted by a jury of Aggravated Fleeing to Elude, punishable by probation or 2-10 years in the Illinois Department of Corrections. The defendant was sentenced to 10 years for this offense. The sentences are to be served consecutively pursuant to state statute.
The defendant’s sentence of 22 years is the maximum allowed under Illinois State Statutes. The defendant will also be required to serve 85% of the 12 year sentences.
